 Conducting expert examinations to determine the country of origin of the goods

By Decree No. 1046 of the President of the Republic of Azerbaijan dated July 27, 2010, the Agreement "On the Rules for Determining the Country of Origin of Goods in the Commonwealth of Independent States" signed in Yalta on November 20, 2009 was approved.

 

These Rules for determining the country of origin of the goods have an effect on the goods coming from the states that are parties to the Agreement in the CIS and in circulation between those states, on which the trade regime provided for in the Agreement on the establishment of the Free Trade Zone of April 15, 1994 is applied.

 

Participating in the meetings of the Working Group on making changes and additions to the Rules for determining the country of origin of goods operating in the CIS Executive Committee in order to benefit more widely from the free trade regime, create fertile conditions for foreign trade activities, and support local exporters and manufacturers within the framework of the states that are parties to the Agreement in the Commonwealth of Independent States. Have a major importance. In this established institution, the employees of the Center actively participate in the discussion of the proposed changes, as well as in the prevention of proposals that are against the export interests of national entrepreneurs and in the direction of putting forward alternative proposals. As a result, the basis for stimulating the export of goods of Azerbaijani origin and increasing the export potential is created.

 

The procedure for determining the country of origin of goods imported from third countries to the customs territories of the states that are parties to the Agreement and exported from those states to third countries is regulated by the national legislation of the states that are parties to the Agreement and international agreements.

 

According to the "Rules for Issuing a Certificate Confirming the Country of Origin of the Goods" approved by the Resolution No. 02 of the Ministry of Economic Development of the Republic of Azerbaijan dated 25.04.2014, customer requests are determined by the Antimonopoly and Consumer Market Control State Service under the Ministry of Economy of the Republic of Azerbaijan. is sent to the Center for the examination.

 

The following documents are attached to the application submitted by the customer:

 

if the customer is a legal entity, a copy of the state registration certificate and an extract from the state register of legal entities;

if the customer is a natural person engaged in entrepreneurial activity without creating a legal entity, a copy of the tax accounting certificate of the natural person;

a copy of the contract concluded between the customer and the buyer (if any);

a copy of the invoice;

a copy of the contract or other confirming documents confirming the purchase of primary raw materials, semi-finished products or other materials involved in the production of the exported product;

if the primary raw material, semi-finished product, or other materials involved in the production of the exported product originate from a foreign country, as a result of processing, there is a change in the position of the product according to the commodity nomenclature of foreign economic activity (XIF EN) at the level of at least one of the first four digits, or the rule of ad valorem share is applied a document (calculation) related to the value of the used materials reaching the percentage of the price of the sent goods.

 

In order to determine the country of origin of goods by the center, the expert reports confirming the results of the examinations conducted in the appropriate manner are drawn up in 3 copies. Accordingly, 2 copies are submitted to the Antimonopoly and Consumer Market Control State Service and the customer, and the other is kept at the Consumer Goods Expertise Center.

 

Depending on the country of export, certificates of origin are provided to customers in the following five forms:

"CT-1" form certificate of origin when exporting goods to CIS countries;

Form "A" certificate of origin when exporting goods to certain countries under the Generalized System of Preferences;

"General" certificate of origin when exporting goods to countries that do not have bilateral and multilateral agreements on free trade and preferential trade regime of the Republic of Azerbaijan;

Certificate of origin in the form "AZ-TR" when exporting the relevant goods to the Republic of Turkey in a specified amount;

Certificate of origin in the form "ST-GUAM" when exporting goods to GUAM countries.

 

Expertises on determining the country of origin of the goods are carried out by the "Center for Consumer Goods Expertise" LLC in Baku city (address: 269 Sh. Mehdiyev street. Yasamal district, Baku city), and the Ganja-Kazakh regional division of the Center in the regions (address: Ganja city. M. Khalafov street 18), Aran regional section (address: Baku pr. 5 in Yevlax), Guba-Khachmaz regional section (address: Khachmaz highway 45), Sheki-Zagatala regional section (address: Sheki sh. A. Mammadov street 43), Lankaran regional division (address: Jalilabad r. H. Aliyev pr. 244e), Absheron regional division (address: Sumgayit s. Sülh street. 1) is conducted.
